Filing The Petition

Once we receive the documents, our legal team and/or representative goes to work preparing the required paperwork for submitting the file to the applicable entity. In total, this process can take 3 to 4 months or longer, depending on the State and complexity of the file.



Cashing Your Check

Once the claim is approved and the funds have cleared our account, your check is immediately issued and sent out to you or the place or person you assign the funds to. Please note, the funds received may be taxable, so we suggest you consult with a tax professional as to any taxes you may owe on the funds collected.

Here are a few answers to our most common questions

How do you get my information?

Our Auditing department performs preliminary audits on homes that were sold at the foreclosure auction to identify individuals and families that may be owed money. We utilize public records to locate and to reach out to these individuals and families via phone, text, email, or direct mail.

How long will this process take?

On average it takes around 3 to 4 months to complete, yet every case is different and could take shorter or longer depending on a variety of factors, such as, which State you reside in, the complexities of the foreclosure process, mortgage history, whether there are liens that need to be satisfied, or how many rightful heirs are involved, etc.

Is this process expensive?

We work on a contingency basis. Our organization funds all upfront expenses (such as legal, notary, filing fees, etc.) for you so that you as our client are not taking on any of the financial risks. We will only get reimbursed with these upfront fees and receive our service fee after we have successfully recovered the money for you. Our service fee is calculated based on a mutually agreed percentage of the actual amount of funds recovered. If for any reason we’re unable to recover any funds for you, we assume all costs and you don’t pay us anything , neither the service fee nor the upfront expenses that we put in for your case.

Do you know the exact amount that is owed to me?

We are not aware of the exact amount owed initially, however, if we’ve contacted you it’s because we believe there is a significant amount that you could ultimately receive. Once we inform the office that is holding the funds of our client’s case, they will then inform us upon their attorney’s review of the title report what amount you are owed. Any liens or judgements reported on the title report would be paid and satisfied first, along with the foreclosure firm’s service fees before an exact amount can be known. Any debt unrelated to the foreclosure, such as credit cards or medical bills would not be considered except in some Bankruptcy cases.

What if the rightful heir is a minor?

In some cases, the rightful heir that is owed the funds is under the age of 18. Our legal staff is equipped at helping the caretaker of the minor become a legal guardian and establishing a Power of Attorney over the minor heir to be able to sign on their behalf so the funds can be released to the family.

What do I need to provide as the heir of the person who is owed?

As each case does vary on a variety of factors, all heirs will need to provide a copy of their Driver’s license, copy of the Death Certificate of the person(s) who is owed, and fill out an Affidavit of heirship which lays out the family tree to prove who the rightful heirs are. Our organization will provide this Affidavit and the support on how to fill it out.
